PEPTO STAR CONTEST*
OFFICIAL RULES
NO PURCHASE NECESSARY
- HERE'S HOW IT WORKS: Create an original video of 1 minute or less that portrays the 5 symptoms of Pepto-Bismol® according to its labeled use and then enter your video into the Contest as per the instructions in Rule #2. NOTE: Videos must NOT contain or depict the 5 symptoms of Pepto-Bismol in a manner that is crude, vulgar or inappropriate as outlined in Rule #2. Your video will then be posted at www.youtube.com/peptobismol (subject to the conditions noted in Rule #2). At the conclusion of the entry period, judges will determine the top 10 entries which will be posted on peptostar.com for visitors to vote to help determine the winners. Videos submitted and posted on youtube.com will be rated by visitors to that site, however, ratings on youtube.com DO NOT determine the contest winners. See Rules #2, #3 and #6 for details on how to enter, eligibility requirements and prizes.
- HERE'S HOW TO ENTER:
- Beginning 11:59 AM (ET) on 10/26/07, visit www.peptostar.com and follow the on-screen instructions to enter your video of 1 minute or less that portrays the 5 symptoms of Pepto-Bismol according to its labeled use. The 5 symptoms of Pepto-Bismol are nausea, heartburn, indigestion, upset stomach and diarrhea.
- You must read and agree to the Procter & Gamble Privacy Policy at http://www.pg.com/privacy/english/privacy_notice.html and YouTube Terms & Conditions at http://youtube.com/t/terms and the YouTube Privacy Policy at http://www.youtube.com/t/privacy.
- There are three steps to enter your video into the Contest:
- Go to the Pepto Star Video Contest Page on YouTube at www.youtube.com/peptobismol and click "Upload". If you are a YouTube member, login and upload your video to your YouTube account. If you are not a YouTube member, follow the instructions to sign up for membership (there is no fee to become a member), and then upload your video to your YouTube account.
- After uploading the video to your YouTube account, go to the Pepto Star Video Contest Page on YouTube at www.youtube.com/peptobismol again and this time submit your video into the Pepto Star Contest Page. To do this, click the "Submit" tab on the Pepto Star contest page, type in your YouTube username, choose the video you want to submit, check the terms and conditions box and click "Add to Contest". Once you have selected the video, you will be asked to confirm your entry via the email used to sign up for a YouTube account. You must do this first before entering the Pepto Star Contest.
- After submitting your video to the Pepto Star Contest page, you will be required to visit www.peptostar.com to register for the contest. You'll need to provide your contact information, the name of your video, and your video's unique YouTube URL. Videos posted at www.youtube.com/peptobismol without also being submitted to peptostar.com are NOT entered into the Contest.
- IMPORTANT: Be sure to save your Submission in the original format after uploading it to the YouTube Pepto Star Contest Channel. If you are a winner, you will need to provide Sponsor with your Submission in its original format in order for the Submission to be used in future advertising.
- ENTRY REQUIREMENTS:
- Not all video submissions will be posted on www.youtube.com/peptobismol. If Sponsor deems that the video submission does not comply with the Official Rules of the Contest or if video depicts usage experiences that do not portray usage of the product in compliance with the Sponsor's standards and the labeled use of Pepto-Bismol (in Sponsor's sole discretion), including videos that depict usage in a manner inconsistent with Pepto-Bismol Directions and Warning Labels, entrant's video will not appear on www.peptostar.com or be eligible to participate in the Contest.
- ALL ENTRIES MUST BE YOUR OWN ORIGINAL UNPUBLISHED WORK AND CANNOT CONTAIN, INCORPORATE OR REFERENCE ANYTHING THAT IS OWNED BY ANY THIRD PARTY OR ENTITY OR WOULD REQUIRE THE CONSENT OF ANY THIRD PARTY OR ENTITY IN ANY JURISDICTION. Videos must be in English and meet the technical specifications to be uploaded and received on YouTube by 11:59 AM (ET) on 1/15/08 and your entry on www.peptostar.com must be received by 11:59 AM on 1/16/08 to be eligible.
- You may enter more than once, however, EACH VIDEO MUST BE DIFFERENT AND A COMPLETED ENTRY FORM MUST BE SUBMITTED FOR EACH VIDEO THAT IS UPLOADED. If any video entry is longer than 1 minute in length, only the first minute will be judged. The video can be in color or black and white and may be enhanced with graphics, special effects and/or animation.
- Submissions must not contain defamatory words/statements (including words or symbols that are widely considered offensive to individuals of a certain race, ethnicity, religion, sexual orientation, or socioeconomic group); they must not include threats to any person, place, business, or group; they must not invade privacy or other rights of any person, firm, or entity, and they must not in any other way violate applicable federal, state, or local laws and regulations. The submission cannot contain any unacceptable clothing or adornments, or display any commercial/corporate advertising (including but not limited to corporate logos, brand names, slogans, political, personal and religious statements) as determined by Sponsor, in its sole discretion. Submissions may not contain indecent behavior, profanities or obscenities, including but not limited to nudity or pornography, and may not in any way reference persons or organizations without their written permission; Sponsor/judges reserve the right in their sole discretion to disqualify any entry that, in their sole opinion, refers, depicts or in any way reflects negatively upon the Sponsor, the Contest or any other person or entity, or does not comply with these requirements or these Official Rules. Submissions must be suitable for presentation in a public forum, in sole determination of judges and/or Sponsor.
- You and up to five additional people may appear in your video but it is not necessary for you or any other person to appear. If the submission contains any person(s) other than the entrant, by entering this contest, entrant must receive prior written permission from other person(s) featured in video (or from parent/legal guardian if other person(s) featured are considered minors in their state of residence) for Sponsor to use their likenesses for publicity including posting on website(s) and can make written copies of such permissions available to the Sponsor upon request. Additionally, if entrant is considered a minor in his/her state of residence, entrant will receive permission from their parent/legal guardian. PERSONS UNDER THE AGE OF 18 MAY NOT APPEAR IN A VIDEO SUBMISSION. In addition, entrant must also receive prior written permission from the videographer of their video if the video entry was taped by someone other than the entrant him/herself. Entrant cannot appear in more than one of the 10 Finalist videos that are posted for voting.
- ELIGIBILITY: Entry into this promotion is open only to residents of the 50 United States or the District of Columbia who are 18 years of age or older at time of entry. Employees of Procter & Gamble, its affiliates, subsidiaries, advertising, promotion and internet agencies and their immediate family members and/or those living in the same household of each are not eligible. All federal, state and local laws and regulations apply. Void where prohibited by law. Eligibility is expressly conditioned on completion of the Publicity Release and the other representations and acknowledgement required at time of submission.
- JUDGING TO DETERMINE THE FINALISTS: All eligible entries will be judged by D.L. Blair Inc., an independent judging organization, to determine the top 50 entries using the following criteria:
- (Originality & Creativity) - (50%)
- (Appropriate portrayal of the 5 Pepto symptoms) - (35%)
- (Suitability for use in an advertisement) - (15%)
In the event of a tie, the tie will be broken based on the highest score for (Originality & Creativity). Judging to determine the 10 Finalists to be posted online for voting will be accomplished by a panel of experts under the supervision of D.L. Blair, Inc. whose decisions are final on all matters relating to this Contest.
- ONLINE VOTING TO DETERMINE THE WINNERS: Beginning 11:59 AM (ET) on 2/13/08 through 11:59 AM (ET) on 3/12/08, the top 10 Finalist videos will be posted on www.peptostar.com. Website visitors will be given the opportunity to vote for their favorite video entry per Rule #4 by following the online instructions. At the end of the voting period, scores from the online voting will be combined with the scores from the panel of experts from the previous round to determine the Grand, First Prize and Finalist winners. Each Finalist entry's percentage of the total votes will carry a 50% weight and the panel of expert scores will carry a 50% weight in the determination of the winners. Voting open to all ages. Limit one vote per e-mail address per day. If more than one vote is received per person per day, only the first vote received will be eligible. In the event of a tie, the tie will be broken based on the highest score from the previous round of Finalist Judging.
- PRIZES: 10 prizes, with a total approximate retail value of $17,700 will be awarded as follows:
(1) Grand Prize - A check for $15,000. The Sponsor may also choose to use the winning video in future advertising. There is no monetary value associated with the use of the video in future advertising; (2) First Prizes - A check for $1,000; (7) Finalist Prizes - A check for $100. Limit one prize per person or household.
- GENERAL RULES: Potential Finalists (or parent/legal guardian if potential Finalist is deemed a minor in his/her state of residence) will be required to complete an Affidavit of Eligibility certifying that the video submitted is his/her own original work and he/she holds all rights to the video and all elements therein, that the video has not been previously published, has not won a previous prize or award and that he/she has followed the Official Rules of the Contest. Additionally, Potential Finalists (or parent/legal guardian if potential Finalist is deemed a minor in his/her state of residence) will be required to complete a Release of Liability, Prize Acceptance Form and, if legally permissible, a Publicity Release. If video entry depicts persons other than the entrant, entrant must also submit a completed and signed Publicity Release Permission Form for each additional person depicted in the entrant's video submission. All documents must be completed and returned within 5 days of attempted delivery of same. Noncompliance within this time period or return of any prize/prize notification as undeliverable will result in disqualification and an alternate finalist will be selected. Winners will be notified by mail/phone. No substitution or transfer of prize by winner permitted. Sponsor reserves the right to substitute prize of equal or greater value. All federal, state, and local taxes are the sole responsibility of winner. By accepting prize, winner (or parent/legal guardian if winner is deemed a minor in his/her state of residence) agree to release and hold Sponsor, their respective directors, officers, employees and assigns, harmless from and against any and all claims and liability arising out of use of prize or any travel in connection therewith. Winner (or parent/legal guardian if winner is deemed a minor in his/her state of residence) assumes all liability for any injury or damage caused, or claimed to be caused, by participation in this promotion or use or redemption of any prize. Acceptance of prize constitutes permission for the Sponsor and its agencies to use winner's name and/or likeness for purposes of advertising and trade without further compensation, unless prohibited by law. Entrants (or parent/legal guardian if entrant is deemed a minor in his/her state of residence) agree to release, discharge and hold harmless Sponsor, its respective directors, officers, employees and assigns, harmless from and against any and all liability and damages. By participating in this promotion, entrants (or parent/legal guardian if entrant is deemed a minor in his/her state of residence) agree to be bound by the Official Rules and the judges' decisions which are final. In the event there is a discrepancy or inconsistency between disclosures or other statements contained in any contest materials and the terms and conditions of the Official Rules, the Official Rules shall prevail, govern and control. All material submitted including the video becomes the sole property of Sponsor and will not be returned. Sponsor not responsible for any typographical or other error in the printing of the offer, administration of the contest or in the announcement of the prize. In no event will more than the stated number of prizes be awarded.

NOTICE TO ONLINE ENTRANTS: ANY ATTEMPT BY AN INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS PROMOTION IS A VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW. Not responsible for faulty, incorrect or mistranscribed phone transmissions, incorrect announcements of any kind, technical hardware or software failures of any kind including any injury or damage to any person's computer related to or resulting from participating in or experiencing any materials in connection with the promotion, lost or unavailable network connections, or failed, incomplete, garbled or delayed computer transmission that may limit a user's ability to participate in the promotion. Sponsor reserves the right to cancel or modify the promotion if fraud, misconduct or technical failures destroy the integrity of the program; or if a computer virus, bug, or other technical problem corrupts the administration or security of the program as determined by Sponsor/judging agency/administrator, in their sole discretion. If technical malfunctions or suspect voting/irregularities corrupt the voting process, Sponsor reserves the right, in its sole discretion, to award prizes based solely on the Finalist Judging scores or non-suspect votes. In the event of termination, a notice will be posted online and entries will be judged from among all eligible entries received prior to termination. Any damage made to the Web Site will be the responsibility of the authorized e-mail account holder of the e-mail address submitted at the time of entry. Proof of submitting entries will not be deemed to be proof of receipt by Sponsor. Any use of robotic, automatic, programmed or the like methods/votes of participation/voting will void all such submissions/votes by such methods. Sponsor reserves the right to prohibit the participation/voting of an individual if fraud or tampering is suspected or if the account holder fails to comply with any requirement of participation as stated herein or with any provision in these Official Rules.
