CHERRY PEPTO "TASTE OF ADVENTURE" SWEEPSTAKES** OFFICIAL RULESNO PURCHASE NECESSARY1. HERE'S HOW TO ENTER: Beginning 12:00 (noon) Eastern Time ("ET") on 10/1/08, visit www.cherrypepto.com and follow the on-screen instructions to register and submit an entry into the Sweepstakes. Entrants will also have the opportunity to submit a story (not to exceed 250 characters including spaces) about his/her own "taste adventure." Stories will not be judged and are not a requirement for entry. Select story submissions (as determined by Sponsor) may be featured on www.cherrypepto.com. Entries must be received during the entry period indicated in the chart below to be eligible for that week's drawing only. Non-winning entries will not be rolled over to subsequent weekly drawings, but will be eligible for the Grand Prize drawing. Entries must be received by 12:00 (noon) (ET) on 2/27/09 to be eligible for the final weekly drawing. If more than one entry is received per person per day, only the first such entry received will be eligible.
2. ELIGIBILITY: This promotion is open only to residents of the 50 United States or the District of Columbia who are 18 years of age or older at time of entry. Employees of Procter & Gamble, its affiliates, subsidiaries, advertising, promotion and internet agencies and their immediate family members and/or those living in the same household of each are not eligible. All federal, state, and local laws and regulations apply. Void where prohibited by law. 3. RANDOM DRAWINGS: (1) Weekly Prize winner will be selected in a random drawing on or about each drawing date indicated in the chart in Rule #1, from among all eligible entries received within the corresponding entry period. In addition, (1) Grand Prize winner will be selected in a separate random drawing on or about 3/5/09 from among all eligible entries received throughout the entire promotion period. Random drawings will be conducted by D.L. Blair, Inc., an independent judging organization, whose decisions are final on all matters relating to this offer. Odds of winning in each weekly drawing will depend upon the number of eligible entries received within the corresponding entry period for that drawing. Odds of winning in the Grand Prize drawing will depend upon the total number of eligible entries received throughout the entire promotion period. 4. PRIZES & APPROXIMATE RETAIL VALUES: 22 prizes, with a total approximate retail value of $6,134.07 will be awarded as follows: (1) Grand Prize: Winner will receive a 4 day/3 night trip for 2 to winner's choice of one of the following destinations: New York City, Los Angeles, Dallas, or Chicago. Prize includes round-trip coach air transportation from major airport nearest winner's home, 3 nights hotel accommodations (1 room, double occupancy), ground transfers to/from hotel/airport, a $400 Dining Gift Card, $1000 spending money, and a Restaurant Guide for the destination city. Winner and guest are solely responsible for all other expenses not specifically set forth herein, including but not limited to meals, additional transportation, baggage fees, souvenirs and other incidentals and items of a personal nature (ARV: $4,500). The actual retail value of the prize will depend on winner's point of departure/return. Winner and guest must travel on same itinerary. (21) Weekly Drawing Prizes (1 per drawing per chart in Rule #1)
Prizes consist of only the items specifically listed as part of the prize. Limit one weekly prize per person or household. Dining Gift Cards subject to gift card terms and conditions. 5. GENERAL RULES: All material submitted becomes the sole property of Sponsor and none will be returned. Story submissions cannot contain any commercial/corporate advertising (including but not limited to brand names, slogans, political, personal and religious statements) and they must not contain defamatory statements (including words that are widely considered offensive to individuals of a certain race, ethnicity, religion, sexual orientation, or socioeconomic group); they must not include threats to any person, place, business, or group; they must not invade privacy or other rights of any person, firm, entity, and they must not in any way violate applicable federal, state, or local laws and regulations. Submissions may not describe indecent behavior, nor contain profanities or obscenities, including but not limited to pornography, and may not in any way disparage persons or organizations associated with Sponsor. Story submissions should not include any personally identifiable information (i.e. last name, address, place of work etc.) of yourself or any other person(s). Submissions must be suitable for presentation in a public forum, in sole determination of Sponsor. Sponsor reserves the right to reproduce the story submissions in full or edit and enhance the submissions at its discretion. Sponsor is authorized to use story submissions as it sees fit, including usage in advertising and online without compensation or opportunity for review by entrant. Not all stories will be posted including those that describe usage experiences that do not comply with Sponsor's standards. By submitting a story submission, entrant grants permission to Sponsor to use story as it sees fit. Sponsor can remove story for any reason at anytime. Potential Grand Prize winner (or parent/legal guardian if potential winner is deemed a minor in his/her state of residence) will be required to complete and return an Affidavit of Eligibility, Release of Liability, Prize Acceptance Form and, if legally permissible, a Publicity Release within 10 days of attempted delivery of same. Noncompliance within this time period or return of any prize/prize notification as undeliverable will result in disqualification and an alternate winner may be selected. Traveling companion (or parent/legal guardian if traveling companion is a minor) must also complete and return a Release of Liability within 10 days of winner's attempted notification. If winner is a minor, winner's parent/legal guardian will be required to accompany winner on trip and will count as the winner's guest. If a minor is selected as a traveling companion, winner must be his/her parent/legal guardian. All travelers must possess required travel documents (e.g., valid photo ID) prior to departure. Travel must be completed within one year of notification. Travel is subject to availability and certain blackout dates may apply. Winners will be notified by mail/overnight delivery. No substitution or transfer of prize by winner permitted. Sponsor reserves the right to substitute prize of equal or greater value. All applicable taxes are the sole responsibility of winner. In no event will more than the stated number of prizes be awarded. By accepting prize, winners (or parent/legal guardian if winner is a minor) agree to hold Sponsor, its respective directors, officers, employees and assigns, harmless against any and all claims and liability arising out of use of prize. Winners (or parent/legal guardian if winner is a minor) assume all liability for any injury or damage caused, or claimed to be caused, by participation in this promotion or use or redemption of any prize. Acceptance of prize constitutes permission for the Sponsor and its agencies to use winner's name and/or likeness for purposes of advertising and trade without further compensation, including a winners' list, unless prohibited by law. Entrants (or parent/legal guardian if entrant is a minor) agree to release, discharge and hold harmless Sponsor, its respective directors, officers, employees and assigns, harmless from and against any and all liability and damages. By participating in this promotion, entrants (or parent/legal guardian if entrant is a minor) agree to be bound by the Official Rules and the judges' decisions which are final. In the event there is a discrepancy or inconsistency between disclosures or other statements contained in any sweepstakes materials and the terms and conditions of the Official Rules, the Official Rules shall prevail, govern and control.
